Nordcapital Treuhand GmbH & Cie. KG (“Nordcapital Treuhand“), the founding limited partner of the closed-end ship fund Nordcapital Bulkerflotte 1 GmbH & Co. KG launched in 2008 with a term until 2026, has achieved a first success in the legal dispute with investors.
On 14 December 2015, the Regional Court of Hamburg rejected the damage claims brought by three investors against Nordcapital Treuhand. The investors had alleged that the participation prospectus launched for the closed-end ship fund was incorrect and incomplete and had demanded the reversal of their investment. The Regional Court of Hamburg now decided that the participation prospectus was neither incorrect nor incomplete and dismissed the actions brought against Nordcapital Treuhand. The plaintiffs have the right to appeal against the decisions.
With the present decisions, the first three out of more than 30 claims due to alleged prospectus errors have been rejected.
