Hengeler Mueller continues to be successful for Nordcapital Treuhand in the defense against damage claims

Hengeler Mueller was once again successful for Nordcapital Treuhand GmbH & Cie. KG ("Nordcapital Treuhand") in the defense against pending damage claims.

In December 2015, the Regional Court of Hamburg rejected damage claims brought by three investors against Nordcapital Treuhand (press report of 22 December 2015). The investors had alleged that the prospectus launched for the closed-end shipping fund was incorrect and incomplete and had demanded the reversal of their investment.

Now, the Hanseatic Higher Regional Court rejected the appeal of the investors with respect to Nordcapital Treuhand in all three lawsuits and denied the appeal to the Federal Court of Justice. Additionally, further 26 out of more than 30 first instance proceedings of investor lawsuits were rejected.
