Drillisch Online GmbH, a subsidiary of 1&1 Drillisch AG, entered into a long-term national roaming agreement with Telefónica Germany GmbH & Co. OHG. The agreed national roaming services complement the envisaged nationwide 5G network of 1&1 Drillisch during the network rollout.
Assured access to national roaming is another milestone on 1&1 Drillisch's path to becoming the fourth mobile network operator in Germany. The agreement is based on a commitment by Telefónica as part of the EU antitrust approval of the merger with E-Plus in 2014.
Hengeler Mueller advised 1&1 Drillisch comprehensively on the contract negotiations and vis-à-vis the German Federal Network Agency (Bundesnetzagentur) and the EU Commission. The team was led by partners Daniela Favoccia (Corporate/M&A, Frankfurt) and Katharina Hesse (M&A/Regulatory, Düsseldorf) and included partners Dirk Uwer (Regulatory, Düsseldorf), Lucina Berger (Corporate), Antonia Hösch (Dispute Resolution) (both Frankfurt) and Markus Röhrig (Antitrust, Düsseldorf/Brussels) as well as associates Daniel Gajek (Frankfurt), Daniel Roggenkemper (both M&A), Norman Koschmieder (Regulatory), Tobias Bieber, Claudia Zschoch (both Antitrust) (all Düsseldorf) and Johanna Peters (Dispute Resolution, Frankfurt).
