Hengeler Mueller successfully represents Zaber Technologies before EUIPO against non-practising entity

Canada based Zaber Technologies Inc., a leading provider of positioning and motion control systems, has succeeded against a non-practising entity before the European Union Intellectual Property Office (EUIPO). Among other things, the opponent had secured the Zaber brand of the identical name for the European market, followed by a trademark attack on a Zaber distribution partner. Zaber Technologies succeeded before the EUIPO in having the Zaber Union trademark declared invalid for bad faith.

Hengeler Mueller represented Zaber in the proceedings. The team included counsel Astrid Harmsen and Andrea Schlaffge as well as partner Wolfgang Kellenter (all IP/IT, Düsseldorf).
