Hengeler Mueller successfully represents Vodafone in claim for cable network feed-in fees against Arte

The German part of the French-German TV channel Arte has to compensate the cable network operator Vodafone for the broadcasting of its programme-carrying signal, according to a decision of the German Federal Court of Justice (Bundesgerichtshof – BGH) (Az. KZR 7/17). The proceedings focused on the status of Arte and resulting antitrust issues regarding concerted practices and the abuse of market dominance at the intersection with public media law.

Hengeler Mueller represented Vodafone in the proceedings. The team included partners Wolfgang Spoerr (Public Law/TMT, Berlin) and Christoph Stadler (Antitrust, Düsseldorf) as well as associates Tobias Schubert (TMT/Litigation) and Cornelia Gersch (Public Law/TMT) (both Berlin). Before the BGH, Vodafone was represented by BGH attorney Reiner Hall (Jordan & Hall, Karlsruhe).
