Hengeler Mueller advises Nordzucker on acquisition of Danisco Sugar and sale of production site Anklam

On 2 March 2009, the acquisition by Nordzucker AG of the European sugar business of Danisco A/S, Denmark, as well as the sale of the sugar and bioethanol production site in Anklam, Germany, to the Dutch food company Royal Cosun were successfully completed. On 17 February 2009, the German Federal Cartel Office had approved the acquisition of Danisco Sugar by Nordzucker, but had required a divestiture of Danisco Sugar’s activities in Anklam.

Hengeler Mueller has advised Nordzucker AG on both transactions, partly in cooperation with Danish law firm Bech-Bruun and various other European firms. Hengeler Mueller’s work included, in particular, German merger control, the coordination of required merger control proceedings in other European countries and the negotiation of the sale of the Anklam activities. The firm’s team included partners Jochen Burrichter (Competition) and Wolfgang Meyer Sparenberg (M&A/Corporate) as well as associates Christian Bürger and Sven Greulich (all Düsseldorf).
