Hengeler Mueller advises EPH on complete acquisition of Schkopau power plant

EP Power Europe, a.s. (EPPE), a subsidiary of Energetický a průmyslový holding, a.s. (EPH), signed an agreement with Uniper on the purchase of Uniper’s majority stake of about 58 percent in the Schkopau lignite-fired power plant in Saxony-Anhalt through Saale Energie GmbH (an EPPE group company). Saale Energie GmbH already holds a stake of around 42 percent in the Schkopau power plant and will thereby take over the plant completely. Completion of the entire transaction is scheduled for October 2021. It is still subject to the approval by the German Federal Cartel Office.

The team included partners Daniel Wiegand (M&A, Munich), Christian Hoefs (Employment, Frankfurt), Dirk Uwer (Public Law/Energy Law), Thorsten Mäger (Antitrust) (both Düsseldorf) and Matthias Scheiffele (Tax, Munich), counsel Jörg Meinzenbach (Public Law/Energy Law, Düsseldorf) and Andreas Breier (M&A/Energy Law, Berlin) as well as associates Achim Spengler, Florian Alexander Dendl (both M&A, Munich), Marius Mayer (Employment, Frankfurt), Frederic Geber, Thomas Ruthemeyer (Public Law/Energy Law, Düsseldorf), Marius Marx and Verena Klosterkemper (both Tax, Munich).
